Circle allows Creators to send email communications to their audiences to market their product and services. Circle has a zero-tolerance spam policy for these email communications. All email recipients must have opted-in, or otherwise validly consented to in accordance with all legal requirements applicable to you, receiving communications from you, the sender.
You are responsible for ensuring that the email communications you send do not generate a number of spam complaints or bounce rates in excess of industry standards. If Circle determines that your level of spam complaints or bounce rate is higher than industry standards, Circle, at its sole discretion, has the right to suspend or terminate your use of our website, products, and services. If you receive low response rates, high complaint rates, high bounce rates, or user complaints, we may request additional information on your sending practices or we may suspend and remove email privileges on your account.
1.
Creator shall:
1.1.
Only use the Services to send email communications to community members and recipients that have agreed to receive email communications and in compliance with all applicable laws;
1.2.
Include an unsubscribe or opt-out option in every email communication sent; and
1.3.
Honor any requests from community members and recipients to unsubscribe, opt-out, or otherwise cease receiving any email communications from Creator within ten days of submission.
2.
Creator shall not:
2.1.
Use the Service to transmit, share, or otherwise provide any content that is false, misleading, deceptive, fraudulent, obscene, defamatory, libelous, threatening, harmful, sexually explicit (including child sexual abuse or exploitation material), indecent, harassing, hateful, or otherwise illegal;
2.2.
Infringe the right of any third-party;
2.3.
Misrepresent or disguise its identity or the origin of any email communications or content therein;
2.4.
Transmit any unsolicited or unauthorized email communication, bulk mail, junk mail, spam, pyramid schemes or other forms of duplicative or unsolicited messages including but not limited to using third-party, purchased, or rented mailing lists and sending unsolicited mail to newsgroups, message boards, and distribution lists; and
2.5.
Creator agrees that it shall cooperate with Circle to investigate and remediate any actual or alleged violation of this agreement.
